Without limiting the generality of the foregoing, Undacut Services LLC does not warrant that the Site will be available on an uninterrupted, timely, secure, or error-free basis; that deal information will be accurate, complete, or current at any particular time; that the Site or its underlying infrastructure will be free from viruses or other harmful components; or that any particular deal will remain available at the time you attempt to access or act upon it.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL UNDACUT SERVICES LLC OR ITS OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SITE, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, OR THE COST OF SUBSTITUTE SERVICES, EVEN IF UNDACUT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

In jurisdictions that do not permit the exclusion or limitation of liability for certain categories of damages, the liability of Undacut shall be limited to the maximum extent permitted by applicable law. Nothing in these Terms shall operate to exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited.

You agree to indemnify, defend, and hold harmless Undacut Services LLC and its officers, directors, members, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with: your access to or use of the Site; your breach of any provision of these Terms; your violation of any right of a third party, including without limitation any intellectual property, privacy, or other proprietary right; or any content you submit, post, or transmit through the Site.

These Terms, and any dispute or claim arising out of or in connection with them or their subject matter, shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of laws principles. Subject to any mandatory consumer protection provisions applicable in your jurisdiction of residence, any dispute that cannot be resolved amicably shall be submitted to the exclusive jurisdiction of the courts of the State of Wyoming. If you are a consumer domiciled within the European Union, you retain any rights afforded to you by the mandatory consumer protection laws of your member state, including any right to bring proceedings before your local courts. The provisions of Section 6 (Intellectual Property), Section 10 (Disclaimer of Warranties), Section 11 (Limitation of Liability), Section 12 (Indemnification), and Section 13 (Governing Law and Dispute Resolution) shall survive any termination or expiry of these Terms, howsoever arising.
